1. Acceptance of Terms

By accessing and using Real Estate Connect ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all visitors, users, agents, and others who access or use the service.

2. Description of Service

Real Estate Connect is an online property marketplace that connects property seekers with estate agents. The Platform allows agents to list properties for sale or rent, and allows seekers to search, enquire, and save properties. We do not act as an estate agent, buyer, seller, landlord, or tenant in any property transaction.

3. User Accounts

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account credentials confidential and secure
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these terms or are inactive for an extended period.

4. Agent Responsibilities

Estate agents using the Platform agree to:

• Ensure all property listings are accurate, truthful, and not misleading
• Hold a valid Fidelity Fund Certificate (FFC) as required by the Property Practitioners Act
• Comply with all applicable South African property laws and regulations
• Respond to enquiries from property seekers in a timely and professional manner
• Remove or update listings that are no longer available

5. Property Seeker Responsibilities

Property seekers using the Platform agree to:

• Use the Platform solely for genuine property searches
• Not submit false or spam enquiries to agents
• Conduct their own due diligence before entering into any property transaction
• Understand that Real Estate Connect does not guarantee the accuracy of any listing information

6. Subscriptions and Payments

Agent subscription plans are billed monthly. By subscribing to a plan, you agree to:

• Pay the applicable monthly subscription fee
• Understand that plans do not auto-renew — you must manually renew each month via the Pay Now button before your plan expires to keep your listings active
• Accept that featured listing boosts are non-refundable once used
• Contact support if you wish to cancel, downgrade, or upgrade your plan

Free trial periods, where offered, will convert to a paid subscription at the end of the trial unless cancelled.

7. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of Real Estate Connect or its content providers and is protected by South African and international copyright laws. You may not reproduce, distribute, or create derivative works from any content on the Platform without prior written consent.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Upload false, misleading, or fraudulent property listings
• Scrape, crawl, or use automated tools to extract data from the Platform
• Attempt to gain unauthorised access to other user accounts or Platform systems
• Transmit viruses, malware, or other harmful code
• Harass, threaten, or abuse other users of the Platform

9. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. Real Estate Connect makes no warranties, expressed or implied, regarding the accuracy, completeness, or reliability of any property listing or information on the Platform. We do not guarantee that the Platform will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by South African law, Real Estate Connect shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. This includes, but is not limited to, damages resulting from property transactions facilitated through the Platform.

11. Indemnification

You agree to indemnify and hold harmless Real Estate Connect, its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses arising from your use of the Platform or violation of these Terms of Use.

12. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the South African courts.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Platform after changes constitutes acceptance of the revised terms.
